Touchbase — Terms & Conditions

Welcome to Touchbase, accessible at https://touchbasezw.com.

Touchbase is an online commercial marketplace connecting business buyers, sellers, suppliers, brokers and other commercial service providers, primarily in Zimbabwe.

By using the platform, creating an account or purchasing an advertising package, you agree to these Terms & Conditions.

1. Platform Services

Touchbase provides online advertising, business discovery and commercial networking services, including:

1. Business-for-sale advertisements
2. Supplier directory listings
3. Commercial asset advertisements
4. Business broker and professional service listings
5. Related marketplace and promotional services

Unless expressly agreed otherwise in writing, Touchbase acts as an advertising and discovery platform and is not a party to transactions between marketplace users.

2. User Accounts

Users must provide accurate registration information and maintain the security of their accounts.

Users are responsible for activity conducted through their accounts and must notify Touchbase of suspected unauthorised access.

Users must be at least 18 years old to purchase advertising services or enter commercial transactions through the platform.

3. Listings and Advertisements

Users submitting listings confirm that:

1. They have the legal authority to advertise the relevant business, asset, product or service.
2. All information submitted is accurate and not intentionally misleading.
3. Photographs and other materials may lawfully be published.
4. Their advertisements comply with applicable laws.
5. They will update or remove listings that are no longer accurate or available.

Touchbase may review, reject, suspend or remove advertisements that violate these Terms, applicable law or platform standards.

Payment does not guarantee approval of an advertisement.

4. Advertising Packages

Touchbase offers paid advertising packages with different prices, durations and included services.

The applicable package details and total price will be displayed before purchase.

Advertising periods ordinarily begin when a listing is approved and published, unless the applicable offer clearly states otherwise.

Advertising fees cover the agreed advertising service and do not guarantee enquiries, buyers, transactions or completed sales.

Subscriptions and advertisements do not automatically renew unless an automatic renewal arrangement is expressly introduced and accepted by the customer.

5. Payments

Customers must review their invoice and pay the exact amount due using an authorised payment method.

Where payment is processed through a third-party provider, the provider's applicable terms may also apply.

A payment provider may use generic checkout terminology. The nature and amount of the customer's obligation are determined by the Touchbase invoice and applicable package agreement.

Listings and subscriptions are activated only after payment verification and any required content approval.

Touchbase may request transaction information or proof of payment to resolve payment discrepancies.

6. Marketplace Transactions

Buyers and sellers are responsible for independently assessing commercial opportunities, verifying information and agreeing transaction terms.

Touchbase does not independently guarantee:

1. Business ownership or legal standing
2. Financial statements or business valuations
3. Profitability or future performance
4. Product quality or availability
5. Seller or buyer identity
6. Completion of transactions

Users should conduct appropriate due diligence and obtain independent professional advice where necessary.

Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

7. Brokers and Third-Party Professionals

Where brokers or other professionals appear on Touchbase, they remain responsible for their own advice, qualifications, services and contractual commitments.

Unless expressly agreed otherwise, any engagement between a customer and a third-party professional is separate from the customer's agreement with Touchbase.

8. Intellectual Property

Users retain ownership of content they submit.

By submitting content for publication, users grant Touchbase a non-exclusive licence to host, display, reproduce and promote that content for the purpose of providing the requested marketplace services.

Touchbase retains rights in its own branding, website design and original platform content.

9. Prohibited Activities

Users may not:

1. Publish fraudulent, unlawful or misleading advertisements
2. Impersonate another person or business
3. Advertise assets or businesses without authority
4. Upload malicious software
5. Attempt unauthorised access to platform systems
6. Use the platform for scams or other unlawful activity
7. Misuse personal information obtained through Touchbase

10. Service Availability

Touchbase aims to maintain a reliable platform but may occasionally experience maintenance, technical interruptions or service disruptions.

Where a paid advertising service is materially affected, Touchbase will assess an appropriate remedy in accordance with applicable law and its Refund & Cancellation Policy.

11. Refunds and Cancellations

Advertising purchases and cancellations are governed by the Touchbase Refund & Cancellation Policy and applicable Zimbabwean consumer protection law.

12. Privacy

Personal information is handled in accordance with the Touchbase Privacy Policy and applicable data protection requirements.

13. Changes to These Terms

Touchbase may update these Terms from time to time.

Material changes will be communicated appropriately. Changes will not retrospectively remove rights already acquired by customers.

14. Governing Law

These Terms are governed by the laws of Zimbabwe, subject to any mandatory legal protections that apply.
